Thank you for choosing 805 Mining Services LLC (“Company,” “we,” “us,” or “our”). By purchasing any product from our website (“Site”), you (“Customer,” “you,” or “your”) agree to these Terms of Sale (“Terms”). Please read these Terms carefully before completing your purchase. If you do not agree with any part of these Terms, you should not proceed with your order.

1. Orders and Acceptance

1.1 Order Placement
You may place an order on our Site by selecting the desired product(s) and following the prompts for checkout. All orders are subject to acceptance by 805 Mining Services LLC.

1.2 Order Confirmation
Once your order is placed, you will receive an email confirming that we have received your order request. This confirmation does not guarantee acceptance of your order. Upon review and approval, we will send an order acceptance or shipment confirmation email, at which point a binding agreement between you and 805 Mining Services LLC is formed.

1.3 Order Cancellation
We reserve the right to cancel and refund your order (the refund will be the amount of cryptocurrency you sent and in the coin you sent) for any reason. This rarely occurs but when it does it’s because a model went out of stock and we weren’t made aware or when the price changes dramatically on a model because of market movements.

2. Pricing and Payment

2.1 Pricing
All prices displayed on our Site are in U.S. dollars (USD), unless otherwise stated. We strive to ensure the accuracy of pricing; however, inadvertent errors or technical issues may occur. We reserve the right to correct such errors and revise your order accordingly or to cancel and refund any affected orders.

2.2 Payment
We accept various forms of payment as indicated on our Site. You acknowledge that the payment method you provide is valid and that you have the authority to use such payment method for your purchase.

2.3 Taxes
Prices do not include applicable federal, state, local, or other governmental sales, use, value-added, or similar taxes. You are solely responsible for paying all such taxes associated with your order unless the tax (sales tax) appears as an item on your order screen.

 

3. Shipping and Delivery

3.1 Shipping Methods
We work with various shipping carriers and methods to deliver your cryptocurrency mining products safely and promptly. Shipping costs and estimated delivery times will be provided at checkout or in your order confirmation.

3.2 Delays in Tracking Information

Please Note: Receipt of tracking numbers can be delayed a few days after shipment due to shipping methods and delays in China. We appreciate your patience and understanding as we work to provide you with accurate tracking details as soon as they become available.

3.3 Risk of Loss
All products purchased from 805 Mining Services LLC are made pursuant to a shipment contract. Risk of loss and title for such products pass to you upon our delivery to the carrier.

4. Product Descriptions and Warranties

4.1 Product Information
We strive to accurately describe our products. However, we do not warrant that product descriptions or other content on our Site are entirely accurate or free of errors.

4.2 Manufacturer Warranty
Some of the products we sell may include manufacturer warranties. If available, details on how to redeem these warranties will be outlined in the product documentation or packaging. Any claims under such warranties should be made directly to the manufacturer.

4.3 Disclaimer of Other Warranties
Except for manufacturer warranties (if applicable), all products and services are provided on an “as is” and “as available” basis without any representation or warranty, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

5. Returns and Refunds

5.1 All Sales Are Final
Due to the volatile nature of cryptocurrency, all sales are final.** We do not offer returns, refunds, or exchanges once a purchase is completed.

5.2 Order Cancellations
All orders are final once placed. We do not accept cancellations after an order has been confirmed or shipped.

6. Cryptocurrency Volatility and Risks

6.1 No Investment Advice
The products sold on our Site are intended for cryptocurrency mining. 805 Mining Services LLC does not provide financial or investment advice and makes no guarantees regarding the success or profitability of any mining activity.

6.2  Assumption of Risk
You acknowledge that cryptocurrency markets are highly volatile and that the value or profitability of your mining setup can fluctuate dramatically. By purchasing from us, you assume all risks associated with cryptocurrency mining, including market volatility, changes in mining difficulty, and other uncertainties.

7. Limitation of Liability

To the fullest extent permitted by law, 805 Mining Services LLC, including its officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly. This includes any loss of data, use, goodwill, or other intangible losses resulting from:

– Your access to, use of, or inability to use the products;
– Any unauthorized access, use, or alteration of your transmissions or content; or
– The conduct of any third party, including any shipping providers or manufacturers.

8. Indemnification

You agree to indemnify, defend, and hold harmless 805 Mining Services LLC, its affiliates, officers, directors, employees, agents, and assigns from and against all losses, liabilities, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from or arising out of your purchase or use of the products, your violation of these Terms, or your violation of any applicable law or regulation.

9. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in San Luis Obispo county California, for the resolution of any disputes.

We reserve the right to modify these Terms at any time in our sole discretion. Any changes will be effective immediately upon posting of the revised Terms on our Site. Your continued use of our Site or purchase of products after any such changes constitutes your acceptance of the revised Terms.

11. Entire Agreement
